Jon T. Simmons

Professional Status:

Mr. Simmons is a partner at Evans Keane LLP. His practice focuses on commercial and complex litigation, including business disputes, constitutional/Section 1983 litigation, contract disputes, product liability, construction, employment, insurance and significant injury litigation.

Formal Education:

Mr. Simmons graduated from Idaho State University in 1991 with a Bachelor of Business Administration degree and obtained his Juris Doctor degree from the University of Idaho, where he graduated with honors in 1994.

Professional Affiliations and Bar Memberships:

Mr. Simmons is a member of the Idaho State Bar Association, and is admitted to practice before the United States District Court for the District of Idaho; the United States Court of Appeals for the Ninth Circuit; and all courts of the State of Idaho.


While in law school, Mr. Simmons was a member of the Idaho Law Review and received the Idaho Law Review Outstanding Student Article award for the year 1992-93. He also received American Jurisprudence Awards for Constitutional Law and Principles of Suretyship. Following law school, Mr. Simmons served as law clerk to the Honorable Linda Copple Trout at the Idaho Supreme Court.

Since 2011, Mr. Simmons has maintained a Martindale-Hubbell AV® Preeminent rating (both Attorney Edition and Judicial Edition), its highest rating in both legal ability and ethical standards.

Representative Matters:

Mr. Simmons has successfully represented individual and business clients in a wide range of cases, and has litigated significant cases with and against some of the finest litigation attorneys in Idaho. His expertise includes representation and litigation in the following areas:

  • Mr. Simmons represents plaintiffs and defendants in complex business disputes, including disputes between existing business affiliates, former business affiliates, and rival or competing business concerns. These cases have involved claims for breach of contract, including licensing agreements, joint venture agreements, and franchise agreements; claims under Article 2 of the Uniform Commercial Code; and tort claims for wrongful interference with contract, interference with prospective economic gain, misappropriation of trade secrets and unfair competition.
  • Mr. Simmons has litigated commercial disputes involving deprivations of due process by state and local government agencies, including litigation under 42 U.S.C. Section 1983.
  • Mr. Simmons has represented plaintiffs, defendants and affected business entities in disputes between owners of partnerships, corporations and limited liability companies, including proceedings to dissolve and wind up a company’s business affairs, proceedings for the appointment of a receiver, disputes over the business operations, claims of usurpation of company opportunities, claims for breach of contract, and tort claims for, among other things, breach of fiduciary duty.
  • Mr. Simmons has successfully represented clients in numerous litigation cases involving real property and improvements thereto. Those cases include nuisance and quiet title cases, adverse possession and prescriptive easement cases, actions for specific performance of real estate sale agreements, construction defect cases, and large tort cases arising from construction developments. Mr. Simmons frequently represents business owners in premises liability matters.
  • Mr. Simmons has litigated insurance cases in state and federal court, and is able to offer a unique perspective on these cases through his representation of both plaintiffs (individuals and businesses) and defendant insurance companies in coverage disputes, bad faith tort lawsuits, and claims for wrongful sales practices and unlawful “twisting” activity by insurance companies under Idaho Code Section 41-1305.
